These Terms of Use ("Terms") govern your use of the WearValue mobile application and related services ("App," "we," "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
You must be at least 13 years of age to use the App. If you are under 18, you should have a parent or guardian review these Terms. Use of the App from jurisdictions where it is illegal or restricted is prohibited.
WearValue helps you evaluate clothing purchases using a "Cost Per Wear" (CPW) calculation and a BUY/SKIP recommendation. The App may use your device camera or photo library to scan garment tags and may send images to third-party services (e.g. Google Gemini) for label recognition. Your use of the App is at your sole risk.
You agree not to: (a) use the App for any illegal purpose or in violation of any law; (b) attempt to reverse engineer, decompile, or extract source code from the App; (c) abuse or overload our or our providers' systems; (d) use the App to collect or harvest data about others without consent; or (e) use the App in any way that could harm, disable, or impair the App or others' use of it.
The App, including its design, text, graphics, and software, is owned by us or our licensors and is protected by copyright and other intellectual property laws. You do not acquire any ownership rights by using the App.
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the App you consent to the practices described in the Privacy Policy. For users in the European Economic Area and other regions, our legal basis for processing is set out in the Privacy Policy.
THE APP AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CPW OR BUY/SKIP RECOMMENDATIONS ARE ACCURATE OR SUITABLE FOR YOUR DECISIONS. YOU USE THE APP AND ANY PURCHASE DECISIONS AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE AND OUR AFFILIATES, OFFICERS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
If you purchase a subscription or other in-app product, additional terms and the applicable app store's (e.g. Apple App Store, Google Play) payment and refund policies apply. We may change subscription pricing or features with notice where required by law.
We may suspend or terminate your access to the App at any time for violation of these Terms or for any other reason. You may stop using the App at any time. Provisions that by their nature should survive (including disclaimers, limitation of liability, and dispute resolution) will survive termination.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute shall be resolved in the courts located in Delaware. If you are in the European Union, you may also have rights under mandatory consumer law in your country.
We may update these Terms from time to time. We will post the updated Terms and update the "Last updated" date. Continued use of the App after changes constitutes acceptance. For material changes we may provide in-app notice or other reasonable notice where required.
